Summary  Information

Bilfinger SE, formerly Bilfinger Berger AG and Bilfinger Berger SE, ("Bilfinger") was an international engineering and services company involved in the industrial services, power services, building and facility services, construction, and concessions business segments. Bilfinger was a German company with its headquarters in Mannheim, Germany.

From about 2003 to 2005, Bilfinger conspired with several other parties to bribe Nigerian officials in order to win and maintain the contracts for the construction of the Eastern Gas Gathering System ("EGGS"), which was a natural gas pipeline system in the Niger Delta designed to relieve existing pipeline capacity constraints. The total amount of the bribes was in excess of $6,000,000, and the contracts to build the EGGS in two phases were worth a total of $387,500,000.

As part of a Deferred Prosecution Agreement with the DOJ, Bilfinger agreed to pay a $32 million penalty to resolve charges that it violated the FCPA. Bilfinger also agreed to enhance its anti-corruption policies and programs as well as its internal controls. The agreement requires Bilfinger to appoint an independent monitor for a term of three years. According to the company's 2016 annual report, the DOJ and the company agreed that the DPA would be extended untill the end of 2018.
