Summary  Information

Robert Gurin, a United States citizen, was the president and sole shareholder of Summerland Engineering Corporation, which, along with its division AEA Aircraft Recovery (AEA), engaged in the business of the recovery of seized aircraft. Gurin was a domestic concern under the FCPA.

Joaquin Pou, a Dominican Republic citizen, was an agent of AEA, Summerland, and Gurin. Thus, Gurin was an agent of a domestic concern under the FCPA.

Alfredo G. Duran, a United States citizen, was an agent of AEA, Summerland, and Gurin. Thus, Duran was an agent of a domestic concern under th FCPA.

Jose Guasch, a United States Citizen, was an agent of AEA, Summerland, and Gurin. Thus, Gausch was an agent of a domestic concern under the FCPA.

According to the allegations in the charging documents, from about April 12, 1989, through about November 5, 1989, the defendants engaged in a scheme to bribe officials of the Dominican Republic in order to induce the officials to assist AEA and Gurin in the recovery of aircraft seized by the government of the Dominican Republic. The aircraft had been seized on suspicion of drug smuggling.

On November 21, 1989, the DOJ filed a single count Indictment against Pou, Duran, and Guasch alleging conspiracy to violate the anti-bribery provisions of the FCPA.

On March 23, 1990, the DOJ filed a single count Information against Gurin alleging conspiracy to violate the anti-bribery provisions of the FCPA. On the same date, Gurin pled guilty to the charge, and on May 2, 1990, the court sentenced Gurin to 5 years probation, 100 hours of community service, and a mandatory assessment of $50.

On April 10, 1990, Guasch pled guilty to the charge against him, and on June 11, 1990, the court sentenced Guasch to 4 years probation, 1 month of house arrest, 75 hours of community service, and a madatory assessment of $50.

On April 19, 1990, Duran was acquitted on motion at trial.

On July 21, 2022, the dismissed the indictment without prejudice against Pou on the grounds that case was no longer viable for prosecution.
